These general conditions of sale govern all sales of Dea Rail products concluded remotely on the website https://dearailjewels.com
The distance selling service governed by the General Conditions is reserved exclusively for consumers; by ‘consumers’ we mean natural persons, over 18 years of age, who act for purposes unrelated to their commercial, entrepreneurial, artisanal or professional activity.

Information relating to products and availability
Each jewel is handmade in all phases of its creation: from wax sculpture to metal finishing. For this reason each piece is unique and may have slight differences from the product shown in the photo. It may take up to 15 business days to produce.
Any small imperfections express the value and authenticity of the jewel.
Each jewel will be delivered in its own packaging accompanied by a declaration of conformity which certifies the quality of the materials and the production process.

Dea Rail reserves the right to limit, at any time, the quantity and/or type of Products that can be purchased on the Site. The style and models of the Products described on the Site may be modified without notice.
Dea Rail is in no case responsible for any errors resulting from the failure of the Customer’s connection to the Site.
Guarantee of authenticity and intellectual property rights
Dea Rail guarantees the authenticity of all Products purchased on the Site. The “Dea Rail” brand products are made with Italian materials, by Italian artisans and are all strictly and entirely MADE IN ITALY.
All “Dea Rail” trademarks, figurative and/or shape trademarks present on the Products, on the related accessories and/or packaging, as well as all illustrations, images and logos protected by copyright, and, more generally, all the intellectual property rights relating to the Products are and will remain the exclusive property of Dea Rail.
Price
The price of the Products indicated on the Site is expressed in Euros (€) and includes VAT and packaging.
Shipping prices are not included. For delivery outside the European Union, customs duties and taxes will be managed and paid by the Customer.
Dea Rail reserves the right to change the price at any time. Purchases already made will be kept at the price paid at the time of the order.
Order
Before sending an order proposal via the Site, the Customer is required to carefully read all the instructions provided during the purchase procedure as well as these General Conditions, the privacy policy and the information on the cookies used.
To purchase a Product, the Customer must (1.) insert the selected Product into the “Cart” by clicking on the appropriate button, (2.) fill in the order proposal, (3.) select the payment method, (4.) accept the Terms and Conditions and (5.) transmit the order proposal to Dea Rail via the Site.
The transmission of the order constitutes a purchase proposal relating to the selected Product, governed by these General Conditions and binding for the Customer, without prejudice to the right of withdrawal. The transmission of the order by the Customer entails the latter’s obligation to pay the price of the Products ordered.
The form with the order proposal and the Customer’s data will be kept by Dea Rail for the period of time required by current legislation, as described in the Privacy Policy. The User accepts the possibility of being contacted by Dea Rail or by the courier who will take care of the shipment for communications relating to the Services via SMS or e-mail.
The contract between Dea Rail and the Customer ends when the Customer receives “the Order confirmation” from Dea Rail.
The Customer will receive an email confirming the purchase and another email in which he is informed on the status of production and sending of the order.
Terms of payment
The accepted means of payment are Paypal, credit card via Stripe which processes payments in total security or Klarna which allows payment to be made in 3 installments without interest.
The transactions will be charged to the Customer’s credit card only after:
• the credit card details have been verified;
• the debit authorization has been received from the company issuing the credit card used by the Customer
It is underlined that Dea Rail will never in any way become aware of the sensitive data relating to the credit/debit cards or accounts used to make the payment which are encrypted through Secure Socket Layer Technology (SSL) and stored securely. All information passes through our server only through the HTTPS connection for greater security.
Transportation and delivery
The purchased Products will be delivered via express courier. The Products will be delivered to the address indicated by the Customer in the order proposal.
Once the shipment has been made, the Customer will be provided with the relevant tracking number.
Please note that shipping services are not available on holidays and days before holidays.
Shipping costs are automatically calculated at the time of purchase by entering the destination location. For orders over €400 it is free in Italy and within the European Union.
Dea Rail is not responsible for duties and taxes that are borne by the Customer
Please consider that the products purchased will remain the property of Dea Rail until delivery. Dea Rail is committed to providing the best possible service. However, it is not responsible for failure to comply with contractual obligations due to unforeseeable circumstances or force majeure. Dea Rail declines all responsibility in the event that the products purchased do not comply with the legislation of the non-EU country of delivery.
Please also note that estimated delivery times should be used as a guide only and Dea Rail is not responsible for any delays caused by heavy traffic, strikes, customs clearance procedures or other causes of slowdowns.
Ownership of the product and related risks pass to you upon delivery.
Returns Policy
Each jewel created by Dea Rail is an entirely handcrafted product that preserves the charm of ancient goldsmith techniques, qualifying itself as a unique piece. Small imperfections are part of the magic of a process that involves exclusive manual intervention at every stage of its creation. We do not offer refunds for these types of features as they are part of the irregular design and finish of our pieces. Please take this into account before purchasing.
All products made to order are excluded from the refund, i.e. jewelery not in stock but made specifically to satisfy the Customer’s order.
However, if the Customer wishes to return jewelery made to order, Dea Rail, once the Product has been received intact and complete with packaging, will give a COUPON (credit) for the sum equal to the price paid net of shipping costs, to be used on the deariljewels.com website.
All sales of items with special discounts or items purchased with a discount code are not subject to return or refund.
If the Customer decides for some reason to proceed with the return of a product, he must notify this in writing within 14 days of delivery by sending an email to info@dearailjewels.com
To correctly exercise the return the customer must:
• communicate the order number and the name of the item you wish to return
• return the purchased Products to Dea Rail, using an express courier, sending them to the following address: Dea Rail c/o Giorgia De Angelis Via Riserva del Bagno 85, 00123 Rome, Italy
• return the jewels intact, unused, undamaged, in the original packaging and with the labels, if present, still attached. In the event of depreciation of the products, due to handling of the same which is not strictly necessary to verify their nature and characteristics, Dea Rail reserves the right to refuse the refund/exchange of the products.
The costs for returning the Products to Dea Rail are borne by the Customer.
Please note that tailor-made Products, according to article 59 of the Consumer Code, cannot be returned. The refund is applicable exclusively to Products in stock.
The Customer is warmly invited to inform Dea Rail before proceeding with the return shipment of the products.
Once the defect of the jewel has been recognised, Dea Rail will notify the Customer of receipt of the return and will give a Coupon equal to the price of the item being returned or, in the case of Products in stock, will provide a refund within 14 days.
Shipping costs are not included in the refund.
Dea Rail is not responsible for the goods before physically returning them to possession and is not responsible for the unsuccessful outcome of shipments of returned products.
Repairs and replacements
If the product purchased for some reason is damaged or requires a replacement, the Customer is asked to write an email to info@dearailjewels.comwithin 14 days of delivery.
It is important that the Customer checks its integrity as soon as he receives the package. If damage has occurred to the packaging, the Customer must immediately notify it by sending an email to info@dearailjewels.com and contest it in writing on the Courier’s delivery note.
